1. Definitions

a. In these terms and conditions unless the context otherwise requires the following words and phrases shall have the following meanings:

i. Buyer means a person to whom UKD supplies Goods or agrees to supply Goods;

ii. Goods means any item which the Buyer buys or has agreed to buy from UKD.

2. Terms & Conditions

This forms part of a user agreement between any user of the Used Kit direct Website or Service and Used Kit Direct (UKD). By using this website the Buyer agrees to be legally bound by these terms and conditions and any revisions. UKD reserves the right to change any aspect of this user agreement at any time at its sole discretion (this may occur from time to time).

3. General

UKD is a wholly owned subsidiary of BNP Paribas Lease Group, a subsidiary of leading international financial institution, BNP Paribas. UKD is an asset disposal agency operating in the finance industry on behalf of a number of finance companies and third parties.

4. Use of Website

This website is intended for the delivery and display of information only. The information, service and products on this website are intended for use by residents of the UK only. It is the Buyer's responsibility to verify any information they may use in making their purchasing decision.

5. Limitations of Liability

a. Whilst UKD has endeavoured to ensure the accuracy of information on this website, UKD cannot offer any warranty nor accept any liability for any losses or damages, direct, indirect, special, consequential or otherwise. UKD cannot ensure that the website will remain available nor the content kept up to date.

b. UKD’s website may from time to time contain links to other sites, UKD has no control over the security of any such websites, therefore the Buyer links to these at its own risk. UKD cannot be liable for any loss or damage which may arise from the use of these third party sites.

c. Although every effort has been taken to accurately portray the condition of products shown on this site, UKD can take no responsibility for the description of the Goods, the condition of the Goods nor the suitability of the Goods for the purpose intended. It is the responsibility of the Buyer to satisfy itself as to the condition of the Goods before placing an offer to purchase the Goods.

d. UKD does not offer for sale the Goods:

i. with any representation, warranty, condition, term or undertaking (whether express or implied) concerning the condition, performance, quality, state, suitability, fitness for purpose, age, capacity, description or use of the Goods or otherwise; or

ii. subject to any representation, warranty, condition, term or undertaking expressed to be implied by statute, common law or otherwise,

and all such representations, warranties, conditions, terms or undertakings (whether express or implied) are excluded to the full extent permitted by law.

e. All representations, warranties, conditions, terms or undertakings (whether express or implied) concerning the supply, non supply or delay in supplying the Goods are excluded to the fullest extent permitted by law.

f. UKD will not be liable to the Buyer:

i. in contract or in tort for any loss, injury or damage arising by reason of any defects in the Goods whether direct or indirect, or whether such defects be latent or apparent on examination (other than liability for death or personal injury arising from the negligence of UKD);

ii. for any statement, term, condition, warranty or representation made by any supplier, dealer, agent, broker or other person through whom this transaction may have been introduced, negotiated or conducted and persons other than those in the employ of UKD have no authority, express or implied to act as agent for UKD.

g. Without prejudice to the remaining terms, the aggregate liability of UKD (whether in contract or for negligence or breach of statutory duty or otherwise howsoever) to the Buyer under these terms and conditions shall be limited to and in no circumstances shall exceed the price paid for the Goods.

h. The Buyer hereby agrees to indemnify and keep UKD indemnified on demand for all claims, liabilities, losses, costs and expenses (including legal fees) incurred or suffered by UKD in connection with any use or misuse of or defect in the Goods, except for personal injury or death caused by the negligence of UKD.

i. If the Goods comprise a motor vehicle or trailer the Buyer agrees that it will not use the Goods on the road in Great Britain or sell or supply or offer to sell or supply the Goods for use on the road in Great Britain in a condition that would be unlawful.

6. Sold as seen

UKD cannot warranty the quality of any mechanical warranty or maintenance contract which may be entered into during the purchasing process. Any contract entered into between the buyer and the third party offering the service does not include UKD either expressly or implicitly.
All goods/items purchased are sold on the basis of SOLD AS SEEN.

7. Offer to purchase

Any price offered by the Buyer on an item of Goods is deemed to be an unconditional offer to purchase which the Buyer is contractually bound to finalise upon acceptance by UKD. Should the Buyer decide not to go ahead with the purchase after making the unconditional offer UKD reserves the right to enforce the unconditional offer made by the Buyer. Failure by the Buyer to complete the purchase contract may (without prejudice to any other remedy UKD may have) result in UKD selling the goods and billing the Buyer for any difference in value between the Buyer's original unconditional offer and the eventual sale price.
By making this offer the Buyer acknowledges the conditions in clause 5 and acknowledges that it is responsible for satisfying itself with regards to the performance, suitability for the purpose intended, description and the condition of the Goods.

8. VAT

Every care will be taken on the part of UKD and its staff to highlight where VAT applies. The Buyer may withdraw from their offer to purchase if VAT implications are not highlighted at time of sale but do in fact apply.

9. Disclaimer

This dislcaimer constitutes the entire agreement between UKD and the Buyer in relation to the use of this website. The agreement supersedes any previous agreements in respect of the Buyer's use of the website. If these terms and conditions are not accepted in full, the use of this site must be terminated immediately.

10. Laws

These terms and conditions are governed by English Law, any dispute regarding the website and relating to these terms and conditions shall be subject to the jurisdiction of the Courts of England.

11. Website Information and Variation

UKD reserves the right to change or modify information portrayed on this site at any time at its sole discretion. UKD may also revise these terms and conditions, please check this page from time to time to ensure the Buyer is familiar with the most current version.
